We conclude that the term "independent contractor" in Section 52-1-22 should be construed as a common-law term; that is, it
should continue to be construed as it has been construed in cases arising under the Act. However, for purposes of clarifying
our case law, we adopt the Restatement (Second) of Agency approach for determining whether one acting for another is an independent
contractor.
